WhereNow - Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the WhereNow Personal Assistant for Dubai service (the “Service”), operated by 🔧 WhereNow  (“WhereNow”, “we”, “us”, or “our”).
By subscribing, paying, or messaging us, you agree to these Terms.

1) What We Do (Service Description)

• WhereNow provides human-led personal assistant support via WhatsApp for planning, recommending, and coordinating restaurants, lounges, clubs, beach clubs, yachts, experiences, and day/night itineraries in Dubai.

• We communicate with venues on your behalf, gather options, and (if you choose) coordinate bookings using the details you provide.

• Unless stated otherwise, WhereNow is not a venue, tour operator, agent, or reseller, and does not provide transportation, security, catering, or other regulated services.

2) Not AI-Driven; Human Judgment

• Our suggestions and curation are made by real people, not automated AI systems.

• Recommendations reflect our professional judgment and local knowledge, but taste is subjective — a popular or well-reviewed event or venue may still not suit your personal preference.

• We do not guarantee that every recommendation or experience will meet your expectations. However, we will always provide as much relevant information as possible so you can make an informed decision.

3) Your Decisions; No Undue Influence

• We never force or finalize bookings without your confirmation.

• We present you with clear options, insights, and pricing details — the final choice is always yours.

4) Subscriptions, Fees & Billing

• Plans: Weekly (for short stays) and Monthly (for regular visitors or residents). Current pricing is displayed at checkout on our website or app.

• WhereNow Host Add-On (optional): adds in-person assistance and hosting in Dubai (see Section 8).

• Fees are charged in advance and cover our assistant service only. Venue costs, deposits, cover charges, food & beverage minimums, tickets, third-party fees, and tips are not included.

• Taxes, FX, and payment processor fees (if any) are the customer’s responsibility.

5) Booking & Payments With Venues

• Some venues may require credit card details or deposits. In such cases, we will arrange the process and send you a secure payment link or connect you directly with the venue.

• We do not store full payment card data.

• Contracts for experiences are between you and the venue/operator, not WhereNow. Venue terms, policies, and cancellation rules apply.

6) Changes, Cancellations & Refunds

• You may pause or cancel future subscription renewals at any time from your account or by messaging us. Cancellation becomes effective at the end of the current paid period unless applicable law states otherwise.

• Service fees are generally non-refundable once a weekly or monthly period has begun, as our team immediately starts working on your requests.

• Venue refunds/deposits follow each venue’s own policy, which may vary during peak dates or events.

7) Response Times & Availability

• We aim to respond quickly and to handle urgent same-day requests whenever possible.

• Actual response and confirmation times depend on venue availability, seasonality, and event schedules. We cannot guarantee specific outcomes or timelines.

8) WhereNow Host Add-On (In-Person Support)

• When activated, the WhereNow Host option connects you with a local host who can, subject to availability, assist you in person — greeting you at venues, coordinating on-site logistics, or facilitating introductions.

• The host is not a chauffeur, security guard, or tour guide; transportation, safety, and conduct remain your responsibility.

• Host schedules are subject to confirmation; we’ll clarify the feasible scope and hours for your requested dates.

9) Your Responsibilities

• Provide accurate preferences, correct guest count, budgets, and times.

• Respect venue policies, including dress codes, ID/age limits (e.g., 21+), and behavior standards.

• You’re responsible for all venue-related charges, including minimum spends, late cancellations, or no-shows.

• You’re responsible for your personal safety, property, and behavior at all times.

10) Conduct & Fair Use

• The Service is for reasonable personal use. Excessive, abusive, or unlawful activity may result in suspension or termination.

• You may not use the Service for illegal purposes, harassment, fraud, or impersonation.

11) Accuracy of Information

• We strive to keep pricing, hours, and policies up to date, but venues may change details without notice.

• We share the latest verified information available at the time, but cannot guarantee venue accuracy until final confirmation.

12) Third-Party Services & Links

• We may share links to third-party platforms (ticketing, payment, or transportation). These are not controlled by WhereNow.

• Your use of third-party services is governed by their own terms and privacy policies.

13) Disclaimer of Warranties

• The Service is provided “as is” and “as available.”

• To the maximum extent permitted by law, WhereNow disclaims all warranties, express or implied, regarding suitability, availability, quality, or fitness for a particular purpose of any venue, event, or experience.

14) Limitation of Liability

• To the fullest extent permitted by law, WhereNow is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of enjoyment or unsatisfactory experiences.

• WhereNow is not responsible for any unpleasant or disappointing experiences at venues, including staff behavior, service quality, or policy enforcement.

• In any event, our total liability for claims related to the Service shall not exceed the total fees you paid to WhereNow in the three (3) months prior to the claim.

15) Indemnity

• You agree to indemnify and hold harmless WhereNow from claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your misuse of the Service or violations of these Terms.

16) Privacy & Messaging

• We use WhatsApp and other tools to communicate and deliver the Service. By using the Service, you consent to receiving messages, calls, and notifications necessary for your requests.

• We handle your personal data per our Privacy Policy (🔧 link). Please avoid sharing payment card numbers or highly sensitive information via chat.

17) Age & Legal Capacity

• You confirm that you are of legal age and capacity to enter into these Terms and to access services that may include alcohol or age-restricted venues (typically 21+).

18) Intellectual Property

• All content, design, and branding on our site or app belong to WhereNow or its licensors. You may not copy, sell, or repurpose any materials without permission.

19) Service Changes & Maintenance

• We may update, improve, or modify features, pricing, or availability at any time.

• Significant changes to these Terms will be communicated through an updated publication date.

20) Suspension & Termination

• We may suspend or terminate your access in cases of misuse, abuse, or violation of law.

• You may cancel at any time as described in Section 6.

21) Force Majeure

• WhereNow is not liable for delays or failures caused by events beyond reasonable control, such as government restrictions, strikes, network outages, or extreme weather.

22) Governing Law & Disputes

• These Terms are governed by the laws of 🔧 United Arab Emirates (and, if applicable, 🔧 Dubai International Financial Centre).

• Disputes shall be resolved under the exclusive jurisdiction of the competent courts of 🔧 [UAE jurisdiction].

• You agree to attempt good-faith negotiation with WhereNow for at least 30 days before any formal claim.
